Cases representing the Plaintiff

Lead counsel for MRI Associates in a breach of fiduciary duty case against St. Alphonsus Regional Medical Center that resulted in a $63.5 million dollar verdict (remitted to $36.3 million). The case was appealed, reversed and retried to a second jury, resulting in a $52.5 million jury verdict. This second verdict was upheld in full by the Idaho Supreme Court, and is believed to be the largest verdict in Idaho’s history.

Lead counsel for developer who sued the Boise County Board of Commissioners for violation of the Fair Housing Act for the commissioners’ failure to approve the development of a residential treatment center in the county. The $4 million jury verdict represents one of the largest awards in the history of the Act. Boise County declared bankruptcy based on its obligation to pay the judgment. On motion led by the developer, the bankruptcy was dismissed, requiring the County to pay the judgment plus attorneys fees.

Lead counsel for sugar beet growers who sued Amalgamated Sugar for the coop’s failure to repurchase growers’ shares. Verdict for growers based on the coop’s violation of the covenant of good faith and fair dealing.

Lead counsel for an individual promised a partnership interest in a lucrative medical imaging business. When the individual was expelled from the partnership and denied his interest payment, the matter was tried, resulting in a verdict in excess of $1 million.

Lead counsel for wood products manufacturer who sued former director of product development for misappropriation of trade secrets. Injunction entered by the trial court prohibited the dissemination of manufacturer’s glue curing technology.

Lead counsel in case brought against Andersen Consulting for failure to properly install and implement SAP system. Case settled favorably for the client.

Lead counsel for prisoner brutally beaten by fellow inmates in the presence of prison guards. Achieved a multi-million dollar settlement for private prison’s failure to adequately supervise and control inmates.

Cases representing the Defense

Defended scores of products liability and construction defect claims filed in over 20 states, while serving as national litigation counsel for a global leader in engineered wood products.

Selected by the LDS Church as counsel to defend the Church’s interests in Idaho-filed cases alleging sexual abuse in connection with Church-related scouting activities.

Represented DBSI, Inc., in defense of claims for fraud, securities violations and other unfair business tactics arising out of the sale of tenant in common (TIC) interests.

Co-counsel for defendant owner of an exclusive mountain resort in a business dispute involving claims seeking hundreds of millions of dollars for fraud, breach of fiduciary duty and collusion with an international bank accused of predatory lending practices.

Lead counsel for Canadian-based natural resources company sued for its failure to pay millions of dollars in fees to the EPCM overseeing the expansion of a phosphate processing facility. After meticulous review of thousands of emails, Mr. Banducci was able to show that EPCM company representatives had been involved in soliciting kickbacks from the project general contractor. Rather than collecting additional fees, the EPCM was required to pay Mr. Banducci’s client $14 million.

Defended owner of an industrial processing facility accused of wrongfully terminating the general contractor’s contract under a “Termination for Convenience” clause.
